1.1
These general terms apply when you as a consumer place an order via www.modeoutlet.dk. The agreement is concluded between you and CJ Fashion Group, CVR: 40202005, ("MODEOUTLET.DK"). Detailed contact details and other information about MODEOUTLET can be found on the webshop. The General Terms only apply to you who are a consumer and place orders via the webshop.

MODEOUTLET is certified by E-Mærket and follows their rules and regulations for distance selling.

1.3
To be able to order on the webshop, the customer must be 15 years old. According to Danish law, MODEOUTLET does not accept credit purchases for persons under the age of 18.   

All images on the webshop must be considered as illustrations. Such illustrations cannot guarantee a representation of the number of products the customer will receive or the exact appearance, function or origin of the product.

The Webshop and all its contents are owned by MODEOUTLET or its licensors. The information is protected by intellectual property rights and marketing legislation, among other things. This means that trademarks, company names, product names, images and graphics, designs, layouts and information about products, services and other content may not be copied or used without the prior written consent of MODEOUTLET.

  1. CONTRACT AND ORDER

2.1
In order to complete an order through the webshop, the customer must accept the General Terms and Conditions. By accepting the General Terms and Conditions, the customer undertakes to follow the General Terms and Conditions in their entirety and approves that he/she has read the information on personal data and consented to the use of personal data and cookies in accordance with MODEOUTLET's Privacy Policy, 

2.2
MODEOUTLET invites the customer to save the order confirmation for any contact with MODEOUTLET's customer service regarding the order. The customer can cancel his order until it has been confirmed by MODEOUTLET.

  1. PRICES, FEES AND PAYMENT

3.1
When ordering via the webshop, the prices indicated apply. All prices are stated in DKK and include VAT. Prices do not include shipping costs, which are listed separately.

3.2
The customer can pay in one of the ways indicated on the webshop. 
- Card payments
- Mobilepay
- Road bill

When purchasing with ViaBill, you will receive your goods first. You must then pay your

monthly payment on the 20th of each month.

If you do not pay on time, a fee of DKK 39 will be charged.

If you regret your purchase, the agreement on payment with ViaBill ends.

ViaBill finances purchases for up to DKK 2,000.

Amounts over DKK 2,000 are financed in collaboration with SparXpress.

We do not charge card fees and the amount is only raised when the item is shipped unless the customer has chosen an invoice or similar payment method approved by MODEOUTLET. In case of invoice or part payment, MODEOUTLET or their business partners can obtain a credit report. In those cases, the customer will be informed of this. Please note that any restrictions on available payment methods are indicated on the webshop.

  1. PROMOTIONS AND OFFERS

MODEOUTLET may from time to time offer special offers on the webshop that may be subject to more favorable conditions than those stated in the General Terms and Conditions, e.g. with regard to payment or extended right of withdrawal. Such conditions will apply for as long as the promotion is active and for the specific products specified by MODEOUTLET in connection with the promotion. MODEOUTLET reserves the right to withdraw such promotions at any time. After termination or withdrawal of a campaign, these General Terms and Conditions will apply without modification. Offers on specific products on the webshop are only valid for a limited time and while stocks last.

  1. DELIVERY AND SHIPMENT

5.1
Products in stock are normally delivered within the number of working days indicated on the webshop. Unless otherwise agreed (e.g. in connection with the reservation of products that are not in stock), the product will be delivered within 30 business days after MODEOUTLET has confirmed the order in writing through the order confirmation. All our shipments are delivered directly to your home address. This is an extra service we at modeoutlet.dk provide to all our customers. 

5.2
The expected delivery time appears in the order confirmation, at checkout and/or on the current product page on the webshop.

5.3
If a package is to be picked up at a delivery location, the customer must do so within the time period specified in the notification. Parcels must normally be picked up in person with valid identification and order number. The customer will receive a delivery notification indicating where and when the package is to be collected. The notification can be sent as e-mail, regular post or via telephone or SMS if the customer has provided a mobile number. If the customer does not pick up the package, MODEOUTLET is entitled to charge the customer the actual cost of a return shipment.

  1. RIGHT OF WITHDRAWAL

6.1
When the customer buys a product on the webshop, he has 14 days to cancel the purchase in accordance with the applicable consumer protection legislation. This means that the customer has the right to cancel a purchase by notifying MODEOUTLET within 14 days of the customer receiving the ordered product.

6.2
The right of withdrawal does not apply to the following types of products:

(a)
products manufactured according to the customer's specifications or with another clearly personalized character,

(b)
products with broken seals that cannot be returned for health or hygiene reasons, or

(c)
sound or image recordings (for example a CD) or computer programs with a broken seal.

6.4
If the customer wants to cancel the purchase, the customer must send a clear and distinct message to MODEOUTLET before the cancellation right has expired. You must state your name, your address and other relevant information, e.g. order number, invoice number and name of the item in the message.

6.5
If the customer uses his right of withdrawal, he is responsible for the condition of the product from the customer's receipt of the product and during the return shipment. The product must be returned within 14 days of notifying MODEOUTLET of the cancellation. The product must be shipped carefully packed and in good condition. We recommend that all returns be sent to MODEOUTLET according to the methods and instructions described on the webshop. You can also use the standard cancellation form, which you will find at the bottom of the trading conditions.

6.6
MODEOUTLET may offer free returns for certain products in certain situations. If free returns apply, this is indicated on the relevant page for the product on the webshop. Unless otherwise stated, you must pay for the return in connection with cancellation yourself.

6.7
When the customer regrets their purchase, MODEOUTLET will refund the amount the customer paid for the product, including the original shipping costs. If parts of an order are returned, the shipping cost will not be refunded. If the item has lost value and this is because you have used it in a way other than what was necessary to establish the nature, characteristics and way of functioning of the item, you can only get a part of the purchase amount back. The amount you can get back depends on the commercial value of the item, and in some cases it may mean you can only get back the shipping costs.

6.8
MODEOUTLET will refund the amount as soon as possible, but no later than 14 days from the date on which MODEOUTLET receives the customer's notice of cancellation. However, MODEOUTLET can wait with the refund until MODEOUTLET has received the product or the customer has presented proof that the product has been returned, e.g. by showing the delivery receipt from the post office. The refund will be transferred to the customer to the same means of payment that was used for the purchase, unless otherwise agreed.

When returning a package, please send us an email with a request for a return and tell us your order number, then we will send you a return label that you can put on the package before handing it in at your nearest post office. 

  1. WARRANTY AND COMPLAINTS

7.1
Some of MODEOUTLET's products may be covered by warranties. Information about any warranty period and special warranty conditions for each product is stated on the Website or in these General Terms and Conditions. Product guarantees will only cover original production defects and thus not defects that have arisen through or after own changes to the product's function and appearance, such as e.g. rebuilding, upgrading or other configuration of the product. the customer's order confirmation constitutes the warranty certificate.

7.2
The Sales Act's rules for purchasing goods apply to consumers who shop at MODEOUTLET. The general right of complaint therefore applies. Any customer wishing to exercise their right of complaint for an ordered product must contact MODEOUTLET as soon as possible after discovering the defect via the contact details provided on the webshop. Complaints submitted within two months after the customer has discovered the defect will always be considered timely submitted. The customer has the right to advertise products purchased on the Website within a period of 2 years after receiving the product.

7.3
FASHIONOUTLET will pay for the return shipping costs for all approved complaints.
When returning a package, please send us an email with a request for a return and inform us of your order number, then we will send you a return label which you must put on the package before handing it in at your nearest post office.

7.4

When a complained product is returned and MODEOUTLET approves the complaint, the customer will be refunded in accordance with applicable consumer protection laws. MODEOUTLET strives for the refund to be made within 30 days of MODEOUTLET receiving the complaint, but this may take longer depending on the product. MODEOUTLET reserves the right to reject any claim if the product is not defective.

  1. LINKS

MODEOUTLET may link to other websites outside of MODEOUTLET's control, and other websites outside of MODEOUTLET's control may link to the webshop. Although MODEOUTLET tries to ensure that MODEOUTLET only provides links to websites that implement data protection and security provisions in accordance with MODEOUTLET's Privacy Policy, MODEOUTLET is not responsible for the protection or confidentiality of information or personal data that the customer provides on other websites. The customer should be careful and read the integrity policies found on the website in question.

  1. CHANGES TO THE GENERAL TERMS

MODEOUTLET reserves the right to change these General Terms and Conditions at any time. Any changes to these General Terms and Conditions will be published on the webshop. Changes will come into effect when the customer has accepted the General Terms and Conditions (in connection with a new purchase. However, MODEOUTLET recommends that the Customer regularly keep updated on the Website, in order to become familiar with any changes to the General Terms.

  1. THE PRINCIPLE OF INSEPARABILITY

If any provision of this Agreement is found invalid or unenforceable by any competent court, authority or arbitral tribunal, the remainder of that provision or all other provisions will continue to be valid and enforceable to the fullest extent permitted by applicable law. Any provision found to be invalid or unenforceable will be replaced with appropriate legal guidance and advice.

  1. APPLICABLE LAW AND DISPUTE RESOLUTION

11.1
Any dispute shall primarily be resolved by common understanding with MODEOUTLET's customer service.

11.2

Access to complaints
If you as a consumer want to complain about your purchase, you must contact (insert email address for relevant person/unit in the webshop). If we are unable to find a solution, you can send a complaint to Nævnenes Hus, Toldboden 2, 8800 Viborg via The complaint portal for Nævnenes Hus.

To be able to complain, the product or service that you want to complain about must have cost at least DKK 1,110 and a maximum of DKK 100,000. For complaints about clothes and shoes, however, the price must have been at least DKK 720. There is a fee to have the complaint processed .

When you shop at an e-branded webshop, you can have your case processed for free - regardless of the size of the amount. Read more her.

In the event of a dispute, MODEOUTLET follows the Consumer Complaints Board or similar dispute resolution body.

11.3
Disputes regarding the interpretation or application of these General Terms must be interpreted in accordance with Danish law and decided in accordance with point 13.2 above or in the last instance by an ordinary court.

12 Personal data policy 
We need the following information when you shop with us:
Name, address, phone no. and email address.

We register and pass on the personal data that is necessary to be able to deliver the goods to you. 


The personal information is registered with CJ Fashion Group ApS and stored for five years, after which the information is deleted. 

We also collaborate with a number of other companies that store and process data. The companies only process information on our behalf and may not use it for their own purposes.

We only work with data processors in the EU or in countries that can provide your information with sufficient protection.

You have the right to be informed about which information we process about you.

If you believe that the information is inaccurate, you have the right to have it corrected. In some cases, we are obliged to delete your personal data if you ask for it. It can, for example, be if your data is no longer necessary in relation to the purpose for which we were to use it.
